Resolution

The general assembly of the Association of Councils of State and Supreme Administrative Jurisdictions of the European Union;

  • Expresses its grave concerns over developments in some Member States that threaten to infringe on fundamental principles of the Rule of Law: the separation of powers and the independence of the judiciary. It reminds all governments that judicial cooperation and comity between the courts requires mutual trust between jurisdictions with regard to the observance of the Rule of Law in all Member States.
  • Strongly supports its members in protesting any national measures that threaten their independence of the judiciary and the force of law of their judgements.
  • Reaffirms the commitment of all its members to the fundamental principles and common values of the European Union with regard to the Rule of Law as laid down in the treaties and in the Charter of fundamental rights of the European Union.
  • Calls upon all institutions of the European Union and the Member States to observe and defend these principles and values with all available means.

15 May 2018 - During its meeting in The Hague, the General Assembly of ACA-Europe brought to his presidency for two years Prof. Dr. Dr. h.c. Klaus RENNERT, President of the German Federal Administrative Court. The German presidency of ACA-Europe began on 15 May 2018 and will end in May 2020. Also read the inaugural speech of the newly appointed President of ACA-Europe, given on the occasion of the assumption of the Presidency.

Furthermore:

Mr Piet Hein DONNER, Vice-President of the Council of State of the Netherlands becomes Vice‑President of ACA-Europe.

Mr Alessandro PAJNO, President of the Council of State of Italy joins the Board of Directors as Vice‑President of ACA-Europe.

Mrs Martine DE BOISDEFFRE, President of the report and studies section of the Council of State of France, is elected Auditor of ACA-Europe.

Mr Jacek CHLEBNY, Vice-President of the Supreme Administrative Court and President of the General Administrative Chamber of the Supreme Administrative Court of Poland is re-elected Treasurer of ACA-Europe.

Mr Geert DEBERSAQUES, President of Chamber at the Council of State of Belgium is re-elected as Secretary General of ACA-Europe
